Re: 2014 TEXAS TITLE INSURANCE AGENT EXPERIENCE REPORT SUBMISSION FOR THE CALENDAR YEAR ENDED DECEMBER 31, 2013

The Texas Department of Insurance issues this mandatory data call under Insurance Code §2703.153, which requires each title insurance company and title insurance agent engaged in the business of title insurance to annually submit certain data to the department.

You must return the attached Acknowledgement of Receipt and Listing of Branch Offices form by fax or email no later than April 28, 2014. The complete set of forms and instructions related to this data call are not included with this mailing, but you may download them from the TDI Title Bulletins web page at www.tdi.texas.gov/bulletins/title.html.

All title agencies must submit their experience data electronically as an attached XML or PDF file to the department on or before June 9, 2014. The Texas Title Insurance Agent Experience Report Submission is an interactive PDF form. To use the interactive form, you must have Adobe Reader version 10.0 or higher on your computer. If you do not have Adobe Reader, you can get it free from Adobe at http://get.adobe.com/reader/. Additional requirements for submitting your data are outlined below.

Title Agent Call for Experience
All Texas title insurance agents must submit Texas title insurance experience according to the General Instruction Manual for Texas Title Insurance Agent Experience Report Submission. You must complete and submit an Affidavit to attest to the accuracy of your report. You may not alter any of the exhibit forms, except to complete the required information. If it is necessary to explain any of the items reported, please do so in a separate attachment or on the Addendum page of the Texas Title Insurance Agent Experience Report Submission form.

Agent/Underwriter Premium Split
The agent/underwriter split of 85:15 percent was in effect for all of calendar year 2013, under Procedural Rule P-23 Division of Premiums between Title Insurance Agents and Title Insurance Companies.

All report submissions must be emailed to DataCall@tdi.texas.gov on or before June 9, 2014. Hardcopies will not be accepted. A complete submission includes:

• an attached .pdf or .xml data file, and
• an attached scanned copy of the signed and notarized affidavit.

Title agents who fail to meet the required deadlines or provide incomplete or inaccurate data will be subject to administrative penalties.
