Re:   2010 TEXAS TITLE INSURANCE AGENTS STATISTICAL REPORT FOR THE CALENDAR YEAR ENDED DECEMBER 31, 2009


This bulletin announces the 2010 call for information. The acknowledgement of receipt and listing of branch offices form included with this letter should be returned by fax, e-mail, or regular mail postmarked no later than May 11, 2010. Please read the directions below on reporting home office issue policies. You will be required to attest to the accuracy of this reporting when you submit your report. Copies of the forms are not included with this bulletin mailing, but can be downloaded from the TDI website address noted at the bottom of this Bulletin.

Title Agent Call for Experience

Pursuant to the authority of §2703.153 of the Texas Insurance Code (TIC), the Texas Department of Insurance requests that all Texas title insurance agents submit information relating to title insurance experience.

Please submit your title insurance experience according to the instructions in the manual. No alterations of the exhibits will be permitted. Should it become necessary to explain any of the items reported, please do so in a separate written attachment.

You are encouraged to submit your experience using the new interactive PDF form. Use of this form significantly reduces errors. Copies of the forms and TACS manual can be downloaded from the TDI website noted at the bottom of this Bulletin or it can be mailed to you upon request.

Please note changes for 2010

This year, the TACS program will no longer be available for use in completing the agent statistical report. Agents must now utilize either the interactive PDF form or the manual copy for submission to the department. Agents choosing to use the interactive PDF form and submitting data via email will not be required to mail a hardcopy report to the department.

Home Office Issue Policy Reporting

Only report premiums for policies written in counties in which you are licensed. Any income received for out-of-county transactions are to be shown as fees received for closing on Form D. Do not show any expenses paid or premium splits paid on out-of-county transactions. If you include any expenses on Form F, those should only be for properties in counties for which you are licensed.

Agency Type

If your agency changed ownership during the past year which resulted in a change in agency type, report the agency type that represents the longest time span during 2009. If the time spans were equal, use the agency type from the earlier period.

Agent/Underwriter Premium Split

The agent/underwriter split of 85%:15% was in effect for the entirety of calendar year 2009.

If submitting using the interactive PDF form, your submission must include:

  • an Email to datacall@TDI.state.tx.us with attached .pdf or .xml data file, and
  • a signed and notarized affidavit faxed to 512-322-5025

If submitting manually, your submission must include:

  • Original completed copies of forms A-L and
  • a signed and notarized affidavit faxed to 512-322-5025

Agents must have their submissions postmarked by June 14, 2010.

Failure to meet the applicable deadline(s) and/or to provide complete and accurate data may result in disciplinary action by the Department.
