Re: Weather Related Event occurring on February 10, 2009 through February 11, 2009

In accordance with the Insurance Code, Section 542.059, and 28 TAC 5.9303, the Texas Department of Insurance has determined the weather-related events occurring on February 10, 2009 through February 11, 2009, in the counties of Anderson, Archer, Bastrop, Bell, Bexar, Brazos, Brown, Burnet, Cherokee, Comal, Comanche, Cooke, Coryell, Culberson, Dallas, Denton, Eastland, Ector, Ellis, Erath, Freestone, Gillespie, Grayson, Gregg, Guadalupe, Hamilton, Harris, Harrison, Hays, Henderson, Hill, Hood, Hopkins, Houston, Hunt, Jeff Davis, Leon, Limestone, Llano, McCulloch, McLennan, Mills, Montague, Nacogdoches, Navarro, Panola, Pecos, Presidio, Reagan, Reeves, Robertson, Rusk, Sabine, Shelby, Smith, Tarrant, Taylor, Tom Green, Travis, Upshur, Val Verde, Wichita, Williamson, Wise, and Wood are a catastrophe for the purpose of claims processing.

Claims resulting directly from the above-defined catastrophe in the counties listed above shall be subject to the additional time periods allowed by Section 542.059, Texas Insurance Code for the processing of claims.

This declaration is provided based upon the representation that the additional time periods are necessary due to the large volume of claims resulting directly from the above-defined catastrophe and with the further understanding that insurers will continue to promptly identify, evaluate and resolve these claims. Insurers shall promptly acknowledge receipt of a claim and make appropriate assignments for the investigation of a claim. Policyholders should continue to receive the timely service that they expect and should not be delayed in receiving the benefits that they deserve because of the additional time periods.
