Broad Form Nuclear Energy Liability
Exclusion - Definition of Waste

The State Board of Insurance has approved a filing by the Insurance Services Office proposing an amendatory endorsement to clarify coverage intent of the standard general liability nuclear energy liability exclusion with respect to waste produced by extraction or concentration of uranium or thorium from any ore processed primarily for source material.

This filing was approved to become effective July 19, 1979. A copy of the amendatory endorsement is attached hereto.

Revision of Supplementary Exclusion
(Contamination or Pollution Endorsement)

The State Board of Insurance has approved a filing by the Insurance Services Office proposing a revision to the standard general liability Supplementary Exclusion (Contamination or Pollution) Endorsement.

This filing was approved to become effective October 1, 1979, in accordance with the following rule of application:

These changes are applicable to all new and renewal policies effective on or after October 1, 1979. No policy effective prior to October 1, 1979 shall be endorsed or cancelled and rewritten to take advantage of or to avoid the application of these changes except at the request of the insured and at the customary short rate charges as of the date of such request but in no event prior to October 1, 1979.

A copy of the revised endorsement is attached hereto.

Real Estate Dealers Errors And Omissions Insurance

General Casualty Bulletin No. 546 announced the approval of a Real Estate Dealers Errors and Omissions Insurance program submitted by INA Underwriters Insurance Company, and copies of the program have been distributed to companies by specific request.

An error has been discovered on the rate page and companies that have obtained copies of the program are hereby requested to record the necessary amendment. Specifically, the word "may" in the first line of Rating Rule No. 4 must be changed to read "shall."

The effective date of this amendment is concurrent with the approval date of the program which was June 15, 1979.

This endorsement modifies the provisions of the Broad Form Nuclear Exclusion used in connection with any liability policy

AMENDMENT TO THE BROAD FORM NUCLEAR EXCLUSION
(DEFINITION OF WASTE)

It is agreed that the definition of " Waste" contained in the Nuclear Energy Liability Exclusion (Broad Form) is amended to read as follows:

" Waste" means any waste material

(a) containing by-product material other than the tailings or wastes produced by the extraction or concentration of uranium or thorium from any ore processed primarily for its source material content, and

(b) resulting from the operation by any person or organization of any

nuclear facility included under the first two paragraphs of the definition of nuclear facility.

(Contamination or Pollution - Described Operations)

It is agreed that, if with respect to operations described in this endorsement there is a discharge, dispersal, release or escape of oil or other petroleum substance or derivative (including any oil refuse or oil mixed with wastes) into or upon any watercourse, body of water, bog, marsh, swamp or wetland, the insurance does not apply to bodily injury or property damage arising out of such discharge, dispersal, release or escape whether or not sudden and accidental.

Oil or Gas Wells acidizing
Oil or Gas Wells cementing
Oil or Gas Wells cleaning or swabbing by contractors

Oil or Gas Wells drilling or redrilling, installation or recovery of casing
Oil or Gas Wells instrument logging or survey work in wells
Oil or Gas Wells perforating of casing
Oil Lease Operators or Gas Lease Operators-natural gas
Oil Pipe Lines operation, including maintenance
Oil Rig or Derrick Erecting or Dismantling - wood or metal - including construction of foundations or structures or installation of equipment

Instructions

This endorsement should always be used whenever the above operations are involved.
