Re:   2014 TEXAS TITLE INSURANCE COMPANY CALL FOR EXPERIENCE FOR THE CALENDAR YEAR ENDED DECEMBER 31, 2013


The Texas Department of Insurance issues the attached mandatory data call under Texas Insurance Code §2703.153, which requires each title insurance company and title insurance agent engaged in the business of title insurance to annually submit certain data to TDI. This call does not include experience for personal property title insurance.

You must return the attached Acknowledgement of Receipt form by fax or email no later than May 15, 2014. TDI has emailed to you the data call documents, including updated spreadsheets.

Please submit your response to TDI by email, and follow up with a hard copy of the entire report along with a signed and notarized affidavit. TDI must receive your response on or before June 23, 2014. Please use the included Excel checklist to validate your report submission. This will enable you to identify and correct potential problems before submitting the report.

Instructions

Instructions for completing Forms 1, 2, 3, 5, 6, 9, 10, 11, and 12 are attached. Forms 4, 7, and 8 are self-explanatory. Refer to your copy of the Texas Title Insurance Statistical Plan for instructions on completing Schedules S-1 through S-6.

You must submit your title insurance experience according to the following:

  • Report all transaction codes for Schedule S-3 electronically. Appendix I contains tables listing the standard transaction codes for Texas operations, including codes that are in effect due to passed legislation.
  • Prepare the experience reported on these Schedules on a "direct basis." Direct basis reporting entails excluding data on reinsurance assumed when reporting premiums and losses, and not making deductions for reinsurance ceded.
  • Complete the attached Income Statement and Balance Sheet Summaries by following the instructions of the American Land Title Association (ALTA) Uniform Financial Reporting Plan.

o ALTA risk codes for completing Form 10 appear in Appendix II.

  • You may not alter the exhibit forms.
  • Enter the name of the reporting company in the space provided at the top of Form 1, and Excel will populate the company name fields on the other forms.
  • If you need to explain any of the items reported , please do so at the bottom of the checklist.
  • Submitting experience reports:

o By email: Submit the completed report to Betty Flores at betty.flores@tdi.texas.gov.

o By mail or by courier: Submit original, signed copies along with a notarized affidavit.

TDI must receive your report submission on or before June 23, 2014.

 

If you fail to meet the required deadlines or provide incomplete or inaccurate data, you will be subject to administrative penalties.
