Re:   CALL FOR FOURTH QUARTER EXPERIENCE - 2011 CALL FOR FOURTH QUARTER EXPERIENCE - 2011 - WORKERS' COMPENSATION DEDUCTIBLE PLANS


The Texas Department of Insurance (TDI) issues the attached mandatory calls pursuant to §2251.008 and §38.001 of the Texas Insurance Code. These calls are the basis for a report required for submission to the Governor and certain members of the Texas Legislature. These calls are designed to provide the Texas Department of Insurance with immediate access to market condition information.

You must complete and return these calls in accordance with the instructions by not later than February 15, 2012. You must maintain underlying data, individual source documents and other information utilized in the development of your call response in your records for a minimum of three years after February 15, 2012.

Failure to comply with the requirements of these calls within the time limits specified may constitute a violation or violations of the Texas Insurance Code and may subject the insurer to the penalties provided by law.

The forms for the call are in a fill-in electronic format using interactive PDF forms and Acrobat 7.0 or higher is recommended. Carriers are encouraged to use these forms that contain internal edit checks to minimize errors. You should download the forms, affidavit, and instructions from the Department's website located at www.tdi.texas.gov/bulletins/index.html.
