The attached mandatory Consumer Information Data Call is being issued pursuant to the General Appropriations Act, Senate Bill 1, 81st Legislature, Regular Session, paragraph 12, page VIII-23, effective September 1, 2009. The information requested is required to complete the quarterly Consumer Information Report that the Texas Department of Insurance (TDI) must submit to the Texas Legislature and the public.
The second quarter 2011 data call must be completed and returned in accordance with the instructions no later than August 24, 2011. This is a firm deadline, and no extensions will be granted. Responses should reflect year-to-date experience (January 1 - June 30, 2011), and reported experience should be valued as of June 30, 2011.
Each insurance company licensed to write one or more of the lines of coverage outlined above in Texas is required to submit the Consumer Information Data Call each calendar quarter, unless the company has been granted an exemption from TDI during a previous reporting period. Licensed companies will only be granted an exemption if a company representative sends an email to HealthSurveys@tdi.state.tx.us stating that the company meets both of the following criteria:
1) The company has no business in force for any of the lines of coverage captured by the data call in Texas, and
2) The company does not intend to enter these markets in the future.
Exemptions are only approved upon written confirmation by TDI. If a company has written premium in Texas during 2011 for a line of coverage captured by the data call after previously receiving an exemption, that company will no longer be exempt from the data call.
Insurance carriers and HMOs must download the data entry form (LHL640) and instructions using the links provided at the end of this bulletin and should carefully review both files before completing the data call. These files are also available on the TDI website at http://www.tdi.state.tx.us/webinfo/datacall.html under the section entitled "Life, Health and Licensing Data Calls".
Respondents must use Adobe Reader 9.0 or higher to complete the data call using the prescribed interactive PDF form. This form contains a "Submit by Email" button that will allow respondents to submit their data to TDI in XML format. Any survey returned in a different format, including scanned PDF files, will not be accepted. All underlying data, individual source documents and other information utilized in the development of your response must be maintained in your records for a minimum of three years after the due date of the data call. This information must be provided to TDI upon request.
Failure to comply with the requirements of this data call within the time limits specified may constitute a violation or violations of the Texas Insurance Code and may subject the insurer to the penalties provided by law.
