The Texas Department of Insurance (TDI) is conducting a mandatory data call for certain information related to claims in the counties of Aransas; Bexar; Brooks; Calhoun; Cameron; Hidalgo; Jim Wells; Kenedy; Kleberg; Nueces; Refugio; San Patricio; Starr; Victoria; and Willacy resulting from Hurricane Dolly. This call for data is designed to provide TDI with immediate access to information necessary to determine the financial impact of the claims related to Hurricane Dolly on the various property and casualty insurers doing business in the State of Texas, including surplus lines insurers, and the property and casualty industry as a whole.
Pursuant to Chapter 401 and 402, and Section 38.001 of the Texas Insurance Code, TDI hereby directs all of the above-referenced insurers, and their agents and representatives to provide data in accordance with the HURRICANE DOLLY REPORTING REQUIREMENTS Memorandum dated August 29, 2008. The 10-day time period otherwise required for responses to inquiries made by TDI pursuant to Section 38.001(c) is hereby extended for the limited purpose of facilitating full compliance with the reporting requirements. Certain property and casualty insurers doing business in the State of Texas will be required to file additional data related to adjusting of claims. Those certain property and casualty insurers will be contacted under a separate reporting requirement memo.
TDI will monitor carriers for compliance with this Bulletin. Failure to comply with the requirements of this Bulletin within the specified time periods may constitute a violation or violations of the Texas Insurance Code.
