Re:   FEES FOR INSPECTIONS CONDUCTED BY THE TEXAS DEPARTMENT OF INSURANCE WINDSTORM INSPECTION DIVISION


Pursuant to Senate Bill 14, Section 9.06, as enacted by the 78th Legislature, Regular Session, 2003, Insurance Code, Article 21.49, §6A(c) has been repealed eliminating the Texas Department of Insurance's (the Department) authority to charge for a windstorm inspection of a structure that is to be considered insurable property through the Texas Windstorm Insurance Association.

Inspection fees are assessed when inspections are conducted by the Department's windstorm inspectors for new construction and additions, to determine compliance of structures with applicable building code specifications. However, effective January 1, 2004, all fees for inspections conducted by the Texas Department of Insurance Windstorm Inspection Division have been eliminated.
