Order CO-03-0128 Requirements for Certain Insurers

To: All Companies listed in Commissioner's Order # 03-0128

Pursuant to Insurance Code Chapter 5, Subchapter P, Article 5.141, enacted by the 78th Legislature and effective on February 26, 2003, the Commissioner of Insurance has issued the attached Commissioner's Order. This Order requires certain insurers to file residential property insurance rates and supporting information with the Commissioner in accordance with the requirements specified in the Order. The Order sets forth the date the filing is due and the information insurers must file with the Commissioner of Insurance in order to comply with Article 5.141.

It is important that insurers file the requested information completely and by the due date specified in the Order. Please be advised that Article 5.141, §7 requires the Commissioner of Insurance, on the 4th day following the date the filing is due, to notify the Governor, the Lieutenant Governor, the Speaker of the House of Representatives, and the members of the Legislature the names of the insurers whom the Commissioner requested to make the rate filings, as well as the names of the insurers who did not respond in whole or in part to the Commissioner's request.

Each insurer named in Exhibits A and B is requested to include with the required filing a statement signed by an authorized officer or agent of the insured that certifies substantially as follows: "My name is ___________________. I am authorized to sign this certificate on behalf of _____________________ (insurer). I certify that the effort of the insurer in accumulating the accompanying information constitutes a good-faith attempt to fully comply with the requirements of S.B. 310. I further certify that, according to the business records of ________________ (insurer), that such information is accurate, and is subject to reasonable verification by resort to business records of the insurer."

If an insurer meets any of the conditions in the attached alternative filing form, please complete the affidavit and submit it in lieu of the requested information in the Order, not later than the date the filing is due.

At 10:00 a.m. on Wednesday, March 5, 2003, the Texas Department of Insurance will hold an open meeting to answer any questions concerning the required filing. The meeting will be held at the Texas Department of Insurance, 333 Guadalupe, Austin, Texas, The William P. Hobby Building, Room 100. Questions and Answers from that meeting will be posted on the Texas Department of Insurance website: www.tdi.state.tx.us.
