FAQ for policyholders of New Century Insurance Company

New Century Insurance Company is a property and casualty insurer, domiciled in Texas, and licensed only in Texas. This notice provides an overview about the condition of New Century.

General information

1. Is New Century still in business?

No. On September 3, 2025, New Century was placed in receivership and ordered into liquidation by the Travis County District Court in Austin, Texas in case number D-1-GN-25-07344.

FitzGibbons and Company, Inc. is the special deputy receiver (SDR) responsible for the day-to-day administration of New Century. Here’s the order appointing the liquidator (PDF).

2. Why is New Century in liquidation?

On September 4, 2025, the Travis County District Court in Austin, Texas issued an order finding New Century was insolvent, placing it into liquidation, and appointing the Texas commissioner of insurance as liquidator.

New Century doesn’t have admitted assets equal to its liabilities and has total adjusted capital less than that required under Texas Insurance Code 841.

3. Can I renew, make changes, or add coverage to my New Century policy?

No. New Century won’t renew, change, or issue policies.

4. Should I get an insurance policy with another company?

Yes. Your policy with New Century Insurance Company will be cancelled on October 3, 2025, at 11:59 p.m. Your insurance agent can help you with options. If you have a mortgage, make sure your mortgage company is OK with your new policy.

5. Will I get a refund for premium paid for the period after the policy is canceled?

Yes. The Texas Property and Casualty Insurance Guaranty Association (TPCIGA) TPCIGA-Receiverships will refund your unearned premium. Unearned premium is the amount you paid in advance that didn't go toward coverage.

You don’t have to file your own claim. The SDR will tell the guaranty association about your unearned premium claim.

The Texas Legislature created TPCIGA to pay property and casualty claims when insurance companies fail. This includes refunding unearned premium payments to policyholders.

6. When am I going to get my refund of unearned premium?

TPCIGA TPCIGA-Receiverships says they will start processing refunds after they get the financial information they need from the SDR. You don’t need to file a claim with TPCIGA for your unearned premium.

7. How much will I get from TPCIGA?

The amount that you already paid New Century for coverage after October 4, 2025 or the policy cancelation date if you buy new coverage before October 4, 2025.

8. How do I ask for a faster refund of unearned premium if I have a hardship situation?

9. What if I have a new claim?

Within a few weeks, new claim filing will transition from the SDR to TPCIGA. When that occurs this FAQ answer will be amended to provide TPCIGA Claims contact information.

10. What happens to claim checks that New Century issued?

TPCIGA will reissue any checks that were issued prior to liquidation after the claim information is transferred to them.

11. What if I have an unpaid claim? Is my claim covered by a guaranty association?

TPCIGA will provide coverage for all eligible New Century policyholders (mostly Texas residents). TPCIGA will pay whichever is lower: your policy limits or the statutory limit of $300,000.

12. What if TPCIGA doesn't cover my claim?

All claims that TPCIGA doesn’t cover should be submitted to the SDR in the proof of claim (POC) process. This includes claims related to insurance policies but denied coverage by TPCIGA.

It doesn’t include claims for amounts over TPCIGA limits (see question 4). It also includes claims for goods or services provided to New Century that aren’t related to insurance policies. If a POC is approved, it may be payable from New Century’s available funds. The SDR can’t predict when or if there will be funds available to pay any approved POCs. 

13. How does the POC process work?

The receivership court will approve a POC form and instructions and set a claims filing deadline. After the court approves the POC form and deadline, the SDR will give notice of the POC deadline to known creditors, publish notice in newspapers, and post the POC form and instructions on the SDR web site.

14. How do I keep up with what is going on in the receivership?

All notices and pleadings filed in the New Century estate will be posted online.
