Re:   PROPERTY AND CASUALTY RATE FILINGS AND SUPPORTING INFORMATION


The Texas Department of Insurance (Department) reminds insurers that rate filings and supporting information filed under Texas Insurance Code Chapter 2251 are open to public inspection as of the date of filing. Texas Administrative Code, Title 28, Sections 5.9310-5.9357, specify the filing requirements for various types of filings, including rate and rate manual filings. Any filing that does not comply with all of the filing requirements may be considered incomplete.

The Department may request additional supporting information related to a rate filing, including actuarial or other reasonable support of rates, as deemed necessary by the Department or the Commissioner of Insurance. Information provided in response to Department requests will be considered a part of the rate filing and will be included with the information made available to the public. Filings and supporting information are not subject to common law confidentiality.

In order to provide more information to the public regarding rates, the Department will now post rate filings and supporting information for homeowners insurance on its Website. Initially, the rate filings of market leaders in Texas will be posted. As resources and time permit, homeowners insurance rate filings of other companies may be posted. As resources permit, rate filings for additional lines of insurance may be posted.
