Re:   Commissioner's Order No. 01-0815 adopting amendments to the Fire Suppression Rating Schedule establishing a new Public Protection Classification and adopting amendments to the Texas Personal Lines Manual, the Texas Statistical Plan for Residential Risks, and the Texas Addendum to the Fire Suppression Rating Schedule.


The Commissioner of Insurance, under Commissioner's Order No. 01-0815, and pursuant to Texas Insurance Code Articles 5.33, 5.96, 5.98, and 5.101 has adopted amendments to the Fire Suppression Rating Schedule (FSRS), the Texas Personal Lines Manual, the Texas Statistical Plan for Residential Risks, and the Texas Addendum to the Fire Suppression Rating Schedule applicable to be effective on and after December 31, 2001.

The amendments to the FSRS establish a new Public Protection Classification, Class 8B, and set forth the criteria for eligibility for the new classification. The inclusion of the new Class 8B will allow additional insurance rate recognition for an improved level of fire protection in areas that are now classified under Class 9 protection. The 8B protection classification is designed to represent a fire protection delivery system that has improved fire fighting capability through equipment, training and management techniques, but which lacks a water supply system capable of the minimum fire flow criteria of 250 gpm for 2 hours.

Amendments to the Texas Statistical Plan for Residential Risks are as follows:

(1) Coding Section (page 16) add option "B" and note for PPC code 8B.
(2) Premiums Section (page 6) add option "B" and note for PPC code 8B.
(3) Losses Section (page 3) add option "B" and note for PPC code 8B.

Amendments to the Texas Personal Lines Manual conformed various sections consistent with the establishment of the new Class 8B classification and deleted outdated rate capping and previous key rate references. The Texas Addendum to the FSRS was amended to correct a typographical error.
