This bulletin is to inform you of the availability of the revised Texas Department of Insurance (TDI) publication "What Texans Should Know about Long-Term Care Insurance" and a reminder of the requirement to submit your annual long-term care rate filing.
28 TAC §3.3840(3) requires companies to provide prospective applicants with a copy of the long-term care shoppers' guide developed by TDI. Please advise your marketing personnel of the availability of the revised publication and adequately stock and supply your agents with the publication to provide to applicants.
For your reference and convenience, a copy of the revised publication suitable for reproduction is enclosed. In addition, the publication may be downloaded from TDI´s Web site at www.tdi.state.tx.us. Please be aware that this publication is for educational purposes only. It does not constitute an endorsement by TDI of any product or service, and companies may not place their name or logo on the publication.
In the case of agent solicitation, the agent must deliver a copy of "What Texans Should Know about Long-Term Care Insurance" prior to the presentation of an application or enrollment form. In the case of direct solicitation, you must furnish the publication to prospective applicants in conjunction with any application or enrollment form.
We hope this publication will help you answer questions from applicants regarding long-term care insurance and will help consumers better understand this type of insurance.
Article 3.70-12 Sec. 4(b), Texas Insurance Code, requires each company providing long-term care insurance to annually file its rates, rating schedule, and supporting documentation demonstrating that rates are in compliance with the applicable loss ratio standards required by 28 TAC §3.3831.
