Commissioner's Bulletin No. B-0005-99 UPDATE

This bulletin announces the 1999 call for information. The reporting requirements are the same as those for the 1998 call. The acknowledgement of receipt form included with this letter should be postmarked no later than February 12, 1999.

Title Agent Call for Experience
Pursuant to the authority of Article 9.07(b) of the Texas Insurance Code, the Department requests that all Texas title insurance agents submit information relating to Title insurance experience.

Please submit your Title insurance experience according to the instructions provided. No alterations of the exhibits will be permitted. Should it become necessary to explain any of the items reported, please do so in a separate written attachment.

You are encouraged to submit your experience electronically using the Title Agent Call System (TACS) provided to agents for the 1998 call. Use of this program can significantly reduce errors. Agents who used the system last year provided very positive feedback about the quality of the program. If you need a copy of the program please contact Michael Davis at 512-322-5029. The program is also available for download from the TDI Internet Website.

The following reports must reflect your Texas experience for the calendar year ended December 31, 1998.

Form B Distribution of Title Premiums
Form C Fees Received for Title Examination and Furnishing Title Evidence
Form D Fees Received for Closing Services
Form E Other Income
Form F Fees Paid for Title Examination and Furnishing Title Evidence
Form G Fees Paid for Closing Services
Form H Recapitulation of Directors Fees
Form I Losses and Loss Adjustment Expenses
Form J Other Expenses
Form K Identification of Owners
Form L Title Insurance Premium by County
Affidavit

Agency Type
If your agency changed ownership during the past year, which resulted in a change in agency type, report the agency type that represents the longest time span during 1998. If the time spans were equal, use the agency type from the earlier period. The affiliated agency definition remains the same as the 1998 call: "A title agency is an affiliated agency if 10% of its ownership is held by a title underwriter or if it is a member of a holding company structure that includes an underwriter."

Agent/Underwriter Split
The agent/underwriter split for the 1999 call remains 17.75/82.25. (Please insert the attached revised manual page into your Title Agent Call System Manual.)

Your submission must include:

* A diskette containing a file exported from the data entry program, a printed copy from the TACS and a signed affidavit; or

* Original completed copies of forms A-L and the signed affidavit.

Statistical reports must be postmarked by March 17, 1999. Failure to meet this deadline and/or to provide accurate data may result in the imposition of sanctions by the Department.
