Re:   Change in Effective Date of the TWIA Building Codes


The Commissioner of Insurance has approved an amendment to 28 TAC §§5.4007 and 5.4008, in Commissioner Order No. 0098-0803; Docket No. 2365 in a hearing held July 6, 1998, changing the effective date of the new Building Code for Windstorm Resistant Construction, and the Windstorm Resistant Construction Guide from June 1, 1998, to September 1, 1998.

The change in the effective date was necessary to allow additional time for building products and materials that meet the new windload and impact resistant requirements to become available in the designated catastrophe areas subject to the new code.

Construction beginning on or after September 1, 1998, will be subject to the new building code requirements, regardless of when the application was received by the Department.

For purposes of this notice, the beginning of construction is defined as physical construction activity.
