Re:   Assignment of Texas Department of Insurance (TDI) Reference Numbers - Surety Bond Forms


This bulletin provides information relating to the approval process for surety bond forms filed by entities other than insurers, i.e. governmental entities. Previously, such surety bond forms filed with the Texas Department of Insurance (TDI) have been approved pursuant to Article 5.97, Texas Insurance Code, which provides for approval of standard forms. In an effort to streamline this time consuming procedure and more efficiently process these filings, the TDI will review the submissions and assign a TDI reference number which can be reference filed by all insurers that wish to use the forms.

Insurers that wish to write any of the bonds described in this bulletin are required to file with the Texas Department of Insurance as outlined in the reference filing procedures contained in Property and Casualty Filings Made Easy currently accessible on our website at www.tdi.state.tx.us.

Assignment of reference numbers does not preclude the independent filing of surety bond forms by insurers for approval by the Commissioner. Insurers must confirm that the form(s) meet the statutory requirements of the appropriate governmental entity, and that the entity finds the forms acceptable.

The Texas Department of Insurance has assigned the following TDI Reference Numbers to surety bond forms submitted by various state agencies:

Reference Number TDI-98-BB155-PF. Commercial Telephone Solicitor´s Bond. This bond is required by Texas Revised Civil Statutes Art. 9023e, and is applicable to individuals (except employees or volunteers) who solicit funds relating to law enforcement, nongovernmental law enforcement organizations, nongovernmental law enforcement publications, and survivors of law enforcement officers who are killed in the line of duty. Reference Number TDI-98-BB155-CACFP. Child and Adult Care Food Program Bond. This bond is required by Texas Administrative Code (TAC), 40 TAC Chapter 12, for certain contractors, facilities and food service management companies participating in the Child and Adult Food Care Program. Reference Number TDI-98-BB150-SFP. Star+Plus Program Performance Bond. This bond is a requirement for delivery of Medicaid services for specific Health Maintenance Organizations as needed, by Texas Department of Human Services, see above for contact.

Reference Number TDI-98-BB150-TNRCC. Payment Bond (Form pab497) and Performance Bond (Form pb497). The bonds are required according to specific contracts with Texas Natural Resource Conservation Commission. State agency contact:

Reference Number TDI-98-BB155-RCT-PF. Commercial Storage, Reclamation, Treatment or Disposal Facility Bond. This bond is required by Texas Natural Resources Code §91.109 and Texas Administrative Code 16 TAC §3.76 for a facility that receives compensation from others for the storage, reclamation, treatment, or disposal of oil field fluids or oil or gas wastes that are wholly or partially trucked to the facility whose primary business purpose is to provide these services for compensation.
