Re:   Change in effective date of the New Building Code for Windstorm Resistant Construction


IMPORTANT NOTICE

The Commissioner of Insurance has proposed an amendment to TAC 28 §§5.4007 and 5.4008, regarding the implementation date of the New Building Code for Windstorm Resistant Construction applicable in the designated catastrophe areas of the Texas seacoast for risks to be considered insurable property for windstorm and hail insurance written through the Texas Windstorm Insurance Association. Under the rule amendment proposal the implementation date is amended from June 1, 1998 to September 1, 1998. No other changes to §§ 5.4007 and 5.4008 are included in the proposal.

The proposed rule amendment will be published in the Texas Register for the required 30-day publication. At the end of the 30-day publication period, the Commissioner will hold a public hearing to consider adoption of the proposed amended effective date of September 1, 1998 for the new building code. Amendment of the effective date of the new building code is necessary to allow an additional three month period for manufacturers to produce the new building products necessary for compliance with the requirements of the new building code and allow building material suppliers to obtain these new products for distribution to home builders. Although under the proposed amendment, the new building code will become effective on September 1, 1998, builders and contractors in the designated catastrophe areas subject to the new building code are strongly encouraged to use the new building code as new products become available for construction, repairs or additions made on and after June 1, 1998.
