Fire Marshal’s Notice

June 2018

Apartments Leased by Universities for Student Housing

To all state universities:

It is the position of the State Fire Marshal’s Office that any apartments or other buildings leased to house students and that are provided by the university for the benefit of the student fall under the jurisdiction of the SFMO and the University FMO or Environmental Health and Safety Office for inspection purposes. This includes apartments where the university collects a payment for the rental of the unit by the student, or the student’s financial aid is used for payment.

SFMO encourages lease agreements with businesses include the following language:

  • That the management/ownership acknowledges the SFMO as the authority having jurisdiction for the business at the time the agreement is signed;
  • That the management/ownership agrees to abide by the adopted standards of the SFMO; and
  • That failure to comply will result in fines or termination of the lease without penalty to the university.
