Effective today, the Commission has adopted a new version of the TWCC-22, "Required Medical Examination Notice or Request for Order" form. This revision was necessary to obtain the information for the monitoring and processing of requests allowed by the legislative changes to Texas Labor Code §408.004 and rule changes to Commission rule 126.5. These provisions allow the carrier to have up to three required medical examinations within a 180 day period under certain circumstances for injuries which occurred on and after September 1, 1997. The changes also require the Commission to monitor the requests for additional required medical examinations and ensure that good cause exists for the additional required medical examinations. The revised form is comprised of four separate parts that may be required to be completed based on the nature of the request or notification.

Part I includes a section for the insurance carrier to indicate whether the request is for a routine (one every 180 days) examination or one of the new additional examinations. Part II includes detailed information about the examination. In addition, it requires the carrier to report the dates of the previous examinations - to help ensure that there are not more than three carrier selected required medical examinations in a 180 day period. Part III provides a means to document the injured employee's agreement to attend the requested required medical examination or to document that there was either no agreement or no response from the injured employee. Part IV provides the means for the Commission to obtain the necessary information regarding the reason for the request for an additional examination under the new legislation. In addition, the form provides a block for the carrier certification and a block for the Commission to complete to order the examination or deny the request. The revised form has been drafted in both English and Spanish, consistent with the requirements of Texas Labor Code §409.013 and Commission rule 126.5.

The new form may be used immediately for routine required medical examinations and is required to be used for any requests for additional required medical examinations (examinations requested before the expiration of 180 days from the previous examination). The previous version of the TWCC-22 form will continue to be accepted by the Commission for routine examinations until March 1, 1998. After March 1, 1998, all requests for or notification of required medical examinations must be submitted on the new form.
