Advisory 94-08

Notification to Employees Regarding Impairment Income Benefits

To minimize the number of disputes involving maximum medical improvement and impairment ratings, a process must be established to ensure injured employees are thoroughly informed about assignment or assessment of an impairment rating, its effect on income benefits and the time limit for disputing the rating.

Effective immediately, insurance carriers shall complete Form TWCC-28, Notification Regarding Maximum Medical Improvement And/Or Impairment Rating (copy attached) and send it with the employee's initial payment of impairment income benefits. If no impairment income benefits are due, the letter shall be enclosed with the last temporary income benefit payment or sent when the carrier determines impairment income benefits are not due. Please do not send a copy of Form TWCC-28 to the Commission.

The Form TWCC-69, Report of Medical Evaluation, used to determine entitlement to impairment income benefits must be attached to Form TWCC-28, Notification Regarding Maximum Medical Improvement And/Or Impairment Rating.
