The Sunset Review of the Division of Workers’ Compensation of the Texas Department Of Insurance
The mission and performance of the Division of Workers’ Compensation are currently being reviewed by the Legislature as required under the Texas Sunset Act. The Act provides that the Sunset Commission, composed of legislators and public members, periodically evaluate state entities to determine if the entity is still needed, and what improvements are needed to ensure that state funds are well spent. Based on the recommendations of the Sunset Commission, the Texas Legislature ultimately decides whether an entity continues to operate into the future.
The Sunset review involves three steps. First, Sunset Commission staff will evaluate the Division of Workers’ Compensation and, in April 2010, will issue a report recommending solutions to problems found. The Sunset Commission will then meet to hear public testimony on the Division and the recommendations of the Sunset staff. This meeting will likely be scheduled for May 2010. Please refer to the Sunset Commission's website or call the office for updated meeting schedule information. Based on public input and the Sunset staff report, the Sunset Commission will adopt recommendations for the full Legislature to consider when it convenes in January 2011.
Through the Sunset review, every Texan has the opportunity to suggest ways in which the mission and operations of the Division of Workers’ Compensation can be strengthened. Suggestions are preferred by Friday, December 18, 2009, so they can be fully considered by the Sunset staff.

Sunset Reports
The Sunset Advisory Commission has completed the staff report for the review of the Division of Workers’ Compensation. The report is now available to the public and is posted on the Sunset website located at www.sunset.state.tx.us/82.htm#wcd under "Staff Report".
About the Sunset Process
The Sunset process allows the Texas Legislature to review the mission and operations of a state agency and determines whether a need for the agency continues to exist. Approximately 130 agencies are subject to the Texas Sunset Act, and agencies are typically reviewed once every 12 years. The Sunset Advisory Commission is charged with reviewing agencies subject to Sunset. Important timeframes for agencies subject to the Texas Sunset Process in 2011 are presented in the following table.
