EXEMPT FILING NOTIFICATION PURSUANT TO THE INSURANCE CODE

CHAPTER 5, SUBCHAPTER L, ARTICLE 5.96

The Commissioner of Insurance, at a public hearing under Docket No. 2543 scheduled for January 22, 2003 at 1:30 p.m., in Room 100 of the William P. Hobby Jr. State Office Building, 333 Guadalupe Street in Austin, Texas, will consider a proposal made in a petition, filed by the Insurance Council of Texas (the Council). The Council´s petition seeks amendment of the Texas Automobile Rules and Rating Manual (the Manual), Rule 74.D. in regard to the two or more autos credit (multi-car discount). The Council´s petition (Ref. No. A-0602-25), was filed on June 28, 2002.

The Council seeks an amendment to Manual Rule 74.D. to expand the scope of the multi-car discount. The current rule makes the mandatory multi-car discount applicable to some, but not all classes of drivers. The Council's proposal would broaden the discount so that it is applicable to all classes of drivers. Furthermore, the current rule makes the multi-car discount applicable to a single policy rather than to a named insured. The rule revision proposed would broaden the discount so that it is applicable to as many autos as the named insured has insured with the one company. The other proposed changes are merely editorial, and not substantive in nature.

Comments on the proposed changes must be submitted in writing within 30 days after publication of the proposal in the Texas Register, to the Office of the Chief Clerk, Texas Department of Insurance, P. An additional copy of comments is to be submitted to Marilyn Hamilton, Associate Commissioner, Property & Casualty Program, Texas Department of Insurance, P. O. Box 149104, MC 104-PC, Austin, Texas 78714-9104.

This notification is made pursuant to Insurance Code Article 5.96, which exempts it from the requirements of the Government Code, Chapter 2001 (Administrative Procedure Act).
