INTRODUCTION

Purpose

This guide is intended to provide assistance to filers with regard to rule, rate, and form filings. The information includes the required filing transmittal form and instructions for each line of insurance. Filers are encouraged to contact the appropriate divisions by telephone, facsimile, or e-mail to address questions prior to submitting a filing.

ADVISORY ORGANIZATIONS

  • General Information - Advisory organizations may file prospective loss costs, supplementary rating information, and policy forms, subject to Chapter 1805, Texas Insurance Code.

    Advisory organizations are subject to the same filing requirements as insurers.

  • Filing Transmittal - The filing transmittal is required to be completed and submitted as outlined in this guide except as noted below:

    • Advisory organization information should be inserted where form asks for Company information.
    • Advisory organization's Texas Department of Insurance (TDI) license number should be inserted where form asks for NAIC No.

  • Subscribers - An insurer that subscribes to an advisory organization must make a reference filing to use the information submitted by an advisory organization. Refer to FORMS-2 and RATES-2 for reference filing requirements.

SERFF (System for Electronic Rate and Form Filings)

  • General Information - On September 15, 1999, TDI began accepting electronic form and rule filings for Property & Casualty companies doing business in Texas. This system is designed to expedite the review and approval of filings and reduce the amount of paperwork.

    TDI SERFF website: www.tdi.texas.gov/company/serff/index.html

    TDI will accept SERFF filings for all commercial and personal lines of insurance.

    General instructions for Electronic Filing Submissions in Texas can be accessed at the above website.
