Risk Retention Groups

Important Notice: Policy Count Exhibit Due March 1

The Company Licensing and Registration Office is responsible for registering Risk Retention Groups. Risk Retention Groups (RRGs) are registered under Texas Insurance Code (TIC), Chapter 2201 and regulations are found in Texas Administrative Code (TAC), Chapter 13. RRGs are self-insurance pools established to retain risks for a certain group of insureds with a common interest. However, the common interest must not be solely for the purpose of obtaining insurance, but because the insureds are a member of a cohesive group with similar liability exposure. Coverage provided by RRGs includes third party liability coverage only, which may consists of: general liability, errors and omissions, officers and directors, medical malpractice, professional liability, and products liability. However, workers compensation, property insurance and personal insurance such as homeowners and personal auto are not allowed under the Federal Liability Risk Retention Act (LRRA). Additionally, certain groups may maintain peripheral coverage in accordance with TIC, Section 2201.251 as amended in the 83rd Texas Legislative Regular Session.
