PREMIUM FINANCE COMPANIES

The Company Licensing and Registration Office is responsible for licensing Premium Finance Companies. A person may not negotiate, transact, or engage in the business of premium financing in this state without first obtaining a license.

Pursuant to Texas Insurance Code, Chapter 651, 651.001, an "insurance premium finance company" means:
(A) a person engaged in the business of making loans under this chapter by entering into premium finance agreements with insureds or prospective insureds;
(B) a person engaged in the business of acquiring premium finance agreements from insurance agents or brokers or from other insurance premium finance companies; or
(C) an insurance agent or broker making loans under this chapter who holds premium finance agreements made and delivered by insureds that are payable to the agent or broker or to the agent's or broker's order.

The requirements of the law and certain exemptions are found in the Texas Insurance Code, Chapter 651-Financing of Insurance Premiums.

The sections of the Texas Administrative Code (TAC) outlining the administration and enforcement of the statute are available for viewing and printing at Texas Administrative Code, 28 TAC §§ Chapter 25. Although we make every attempt to ensure the currency of the code references on this page, they should be used only as guides. The TAC is subject to change at need, and the TIC changes a few months after a legislative session.
