Current Opportunity: Administrative Law Judge

Internal/External Posting – TDI Employees and General Public

The Administrative Law Judge presides over Contested Case Hearings on indemnity disputes arising under the Texas Workers’ Compensation Act, and over appeals of independent review organizations regarding determination of medical necessity for health care services.


This position:

  • conducts contested case hearings involving indemnity, medical necessity and medical fee disputes;
  • rules on pre-hearing matters and motions;
  • swears in witnesses, receives testimony, allows examination and cross-examination of witnesses;
  • allows the presentation of evidence by summary measures, ensuring the rights of the parties are preserved;
  • develops the facts required to permit making the factual determinations necessary to resolve the legal issues in dispute;
  • judges the relevance and materiality of the evidence offered and the weight and credibility to be given to the evidence;
  • resolves the issues in dispute based on current legal precedent established by the Texas Workers’ Compensation Act, Division of Workers’ Compensation Rules, Appellate Court Decisions, and Appeals Panel Decisions;
  • writes decisions and orders that are legal, factual, and grammatically correct upon completion of a contested case hearing;
  • generates various work products with minimal or no clerical/administrative assistance;
  • rules on motions and issues procedural orders;
  • completes required computer data entries that memorialize any contact with parties to a claim, and support granting of continuances;
  • travels on a consistent basis; and
  • performs other duties as assigned.

Qualifications

Graduation from an accredited law school with L.L.B. or J.D. degree.


Additionally, this position requires:

  • two years of experience as a practicing attorney;
  • a license to practice law a practice law in the State of Texas, and
  • a writing sample, of no more than 10 pages, must be submitted with the application. The writing sample should not have been authored by anyone other than the applicant.

Preferences for this position include:

  • experience in the Texas Workers’ Compensation system; and
  • prior experience as an administrative law judge or litigator.

This position requires demonstrated knowledge of:

  • the Texas Workers’ Compensation Act and Rules;
  • medical terminology; and
  • word processing and personal computers.

This position requires demonstrated skill in:

  • problem solving, decision making, and planning;
  • the use of automated equipment;
  • using Microsoft Office software applications, including Word and Outlook;
  • using personal computers sufficient to enter and extract data from related systems and programs; and
  • operating a motor vehicle in a safe courteous manner in compliance with traffic laws.

This position requires the demonstrated ability to:

  • apply critical thinking to evaluate, analyze and interpret information;
  • efficiently and fairly conduct hearings and write decisions that are legally and grammatically correct, with minimal administrative and clerical support;
  • effectively communicate both orally and in writing;
  • manage multiple tasks and meet deadlines;
  • manage complex and highly technical functions; and
  • satisfy the conditions required to maintain fully-qualified driving status.
