Current Opportunity: Staff Attorney

Internal and External - TDI Employees and the General Public

The Staff Attorney performs highly complex (senior-level) attorney work, for the Division of Workers’ Compensation (DWC) Enforcement section. Work involves providing legal support on regulatory matters such as enforcement input on division rules, policy, and other legal issues. Additionally, the Staff Attorney investigates and litigates administrative enforcement actions against health care providers, insurance companies or other system participants.


This position:

  • represents the TDI-Division of Workers Compensation in disciplinary actions concerning health care providers, designated doctors, insurance carriers, and other system participants in the workers’ compensation system;
  • assist in the intake, investigation, and resolution of complaints concerning alleged violations of the Texas Labor Code, Texas Administrative Code, or Texas Insurance Code.
  • provides legal input to the Office of Medical Advisor regarding potential enforcement actions and participates in the divisions medical quality review process;
  • draft briefs, pleadings, motions, legal memos, negotiated settlements, consent orders, warning letters, other correspondence related to enforcement actions, contested cases, and hearings.
  • confers with General Counsel to provide legal advice and opinions for the Commissioner of Workers’ Compensation or other agency employees on administrative violations; and
  • perform other duties as assigned.

Qualifications

  • Graduation from an accredited law school with a J.D. or LL.B degree.

Additionally, this position requires:

  • four years of full-time legal experience as a licensed attorney including litigation experience with a focus on workers’ compensation, administrative law or medical malpractice; and experience with application of complex statutory and rule provisions.

Preference for this position includes:

  • experience in the area of workers compensation and/or experience in medical reimbursement systems such as Medicare; and six years as a licensed attorney including litigation experience with a focus on workers’ compensation, administrative law or medical malpractice.

This position requires the demonstrated knowledge of:

  • legal principles, practices, and administrative proceedings, and of laws, regulations, rules relating to the agency such as the Texas Workers’ Compensation Act, the Texas Administrative Procedures Act, and the Public Information Act;
  • civil evidentiary techniques and procedural requirements; and
  • word processing and word applications, experience in the preparation of pleadings, legal documents and briefs.

This position requires the demonstrated skill in:

  • problem solving, decision making and planning;
  • skill in legal research, writing, and analysis; and
  • communicating and working effectively with all levels of employees, government officials, and the public.

This position requires the demonstrated ability to:

  • exercise good judgment in the analysis of legal problems and to prepare sound, clear opinions;
  • comprehend and apply the Texas Insurance Code, Texas Labor Code and the Texas Administrative Code;
  • coordinate investigations and prepare witnesses and evidence for administrative hearings;
  • use critical thinking to analyze and solve legal problems and interpret laws and regulations affecting the agency;
  • organize and manage multiple competing priorities and cases;
  • express comments and legal opinions logically persuasively, both verbally and in writing;
  • deal tactfully and professionally with the public, co-workers, and agency personnel;
  • to exercise mature judgment in the analysis of legal problems and preparation of legal opinions; and
  • provide commitment to public service.
