Texas Department of Insurance

Current Opportunity: Attorney III

Internal/External Posting – TDI Employees and General Public

The Attorney III works in the Office of Policy Development Counsel and performs moderately complex attorney work, including: planning and organizing work, examining and preparing legal documents, providing legal advice and opinions, participating in administrative hearings, and interpreting laws and regulations.


This position:

  • advises staff on legal matters, including the interpretation and application of agency regulations, and state and federal laws;
  • researches state and federal laws and regulations;
  • drafts legal opinions and memoranda on regulatory matters;
  • researches, analyzes, and drafts administrative rules and orders;
  • researches, drafts, and assists in drafting bills and amendments for legislative consideration;
  • assists the Attorney General's office in preparing cases for litigation; and
  • performs other duties as assigned.

Qualifications

This position requires graduation from an accredited law school with a J.D. or LL.B degree. 


Additionally, this position requires:

  • a license to practice law in the State of Texas; and
  • three years of regulatory or administrative law experience--prelicensure legal clerkships or internships may be applied on a year-for-year basis;
  • a resume to be submitted with the application; and
  • a writing sample of no more than 10 pages, double-spaced, in 12-point font, to be submitted with the application. The writing sample should not have been authored by anyone other than the applicant.

Preferences for this position include:

  • experience with life and health insurance regulation, property and casualty insurance regulation, or administrative law; and
  • experience in drafting rules and legislation.

This position requires demonstrated knowledge of:

  • legal principles, practices, and proceedings;
  • state and federal laws, rules, and regulations, with emphasis on the Texas Insurance Code, the Texas Administrative Procedure Act, and the Texas Register Act;
  • state and federal rules of evidence and procedures, evidentiary techniques, and procedural requirements for administrative proceedings;
  • agency administrative rules and regulations;
  • legislative drafting techniques;
  • property and casualty insurance regulatory law; and
  • life, accident, and health insurance regulatory law.

This position requires demonstrated skill in:

  • problem solving, decision making, and planning;
  • legal research, writing, and analysis, including plain English legal writing;
  • using a personal computer and applicable software, including word processing;
  • using reasoning and logic;
  • using negotiation and mediation to resolve disputes quickly and effectively, at the lowest level possible;
  • identifying and solving complex problems;
  • prioritizing workloads;
  • using good judgment to analyze legal problems and identify courses of action; and
  • project management and/or team leadership.

This position requires the demonstrated ability to:

  • participate and assist staff in administrative hearings;
  • prepare opinions and briefs;
  • identify and analyze legal problems, and prepare sound, clear opinions;
  • research moderately complex legal issues efficiently;
  • summarize research findings clearly and effectively;
  • interpret laws and regulations affecting the agency;
  • use or learn to use relational databases and tracking systems;
  • use electronic and hard-copy legal reference materials;
  • express comments and legal opinions clearly and persuasively;
  • deal tactfully and professionally with the public, co-workers, agency staff and industry representatives;
  • explain legal concepts to lay persons;
  • communicate and work effectively with agency staff, the insurance industry, governmental officials, and the public;
  • work independently; prioritize cases, and meet deadlines;
  • organize and manage multiple priorities; and
  • respond to dynamic situations on an as-needed and case-by-case basis.
