Chiropractors meeting notes- September 2009

Outreach to Chiropractors: Amy Rich, Division of Workers' Compensation (DWC), invited TCA members to join her provider Listserve to receive e-mail notices about DWC rules, meetings and other information of interest to chiropractors; contact Amy at 512-804-4809. In September DWC is sponsoring educational conferences in Austin and Dallas, and also one-day provider trainings in Wichita Falls, Dallas, Victoria, and other cities. DWC is seeking input from stakeholders on rules including Chapter 180 rules, pharmacy formulary, and e-billing. TCA's mid-winter conference is in February 2010 and TDI will have an exhibit at the conference.
Legislative Update: For more information about recently passed legislation of interest to providers, please review the summary in TDInsight at www.tdi.state.tx.us/pubs/insight/200909.pdf. In particular, chiropractors may wish to note these bills:

Complaints Update: In 2009, Consumer Protection has received 78 complaints from chiropractors, compared to 27 in 2008. DWC is seeing a decrease in complaints from chiropractors: 40 in 2009 to date compared to 160 in 2008. Teresa Carney added that many are medical fee disputes that are handled via the DWC medical fee dispute resolution process, not the complaint process. DWC's practice is to call chiropractors to explain how to file a medical fee dispute. She also clarified that there is no fee to go through the medical fee dispute resolution process; there is a fee to request an independent review. In addition, performance-based oversight planning will begin soon and DWC welcomes representation from TCA.
Fraud Update: Dennis Pompa reported that a lawsuit has been filed re: the constitutionality of HB 148, the "solicitation" bill that recently passed. TCA is working with the Office of the Attorney General on this matter. In addition, the Texas Department of Transportation is expected to issue a new rule this month that would remove the phone number from an accident report. The next meeting of the Texas Committee on Insurance Fraud is October 14.
