Texas Nations Title Agency Resource Page

On July 16, 2009, the Travis County District Court entered an Agreed Order of Liquidation and Permanent Injunction against Texas Nations Title Agency, Inc. finding Texas Nations Title to be insolvent.

The Commissioner has been named the Liquidator
The Agreed Liquidation Order names Mike Geeslin, Texas Commissioner of Insurance, as the liquidator of Texas Nations Title. Members of the liquidator’s staff are handling all of the company’s affairs, in order to ensure that the liquidator maintains control over assets and operations.

Permanent Injunction and Automatic Stay
Because Texas Nations Title is now in liquidation, there is an automatic stay in place under Chapter 443 of the Texas Insurance Code. The stay prohibits banks, collection agencies, and other entities from trying to collect money from a consumer if that money should have been paid by Texas Nations Title. The stay prohibits collection activity, accrual of fines and penalties, and any other similar activities. For example, if a consumer has money in a Texas Nations Title escrow account to pay homeowner’s association fees, the homeowner’s association is prohibited under the stay from requesting that the consumer pay those fees out of his or her own pocket.

Company has Closed Operations
Prior to the Liquidation Order, Texas Nations Title had essentially closed its doors and ceased conducting new business. The effect of the liquidation order is that the liquidator is in charge of winding down the existing business and dealing with all outstanding issues.

The Commissioner has designated Texas Nations Title as an Impaired Agent
The Commissioner has issued an order designating Texas Nations Title as an impaired agent under Chapter 2602 of the Texas Insurance Code. The designation as an impaired agent, combined with the Travis County District Court’s finding of insolvency, has triggered coverage by the Texas Title Insurance Guaranty Association (TTIGA).

Open Guaranty Files and Escrow Funds held by Texas Nations Title
When a title agent is designated as impaired and TTIGA is triggered, claims for escrow funds held by the impaired entity are processed and paid by TTIGA subject to statutory limitations. TTIGA will send notice to all affected parties with instructions for filing the necessary documentation to secure the release of escrow funds. Notices and the forms for filing a claim will also be posted on TTIGA’s website at www.ttiga.org. TTIGA may be contacted by phone at 512-474-1587 or by e-mail at contact@ttiga.org

Q. I require information contained in guaranty files at Texas Nations Title from a past closing. Will Texas Nations Title respond and take care of closing or post-closing issues?
A. No. Texas Nations Title is no longer conducting business and closing files. Consumers or other claimants who have open files at Texas Nations Title should contact the toll free hotline above or TTIGA (regarding escrow claims) for further assistance. Due to the state of Texas Nations Title records and files there could be some delay in responding to inquiries that request specific information.

Q. Texas Nations Title is holding escrow funds that are owed to me in relation to a real estate deal – when can I get my money?
A. At this time the liquidator cannot provide a specific date on which claimants will have their escrow funds on closed and pending transactions. Claimants with questions about the release of escrow funds should contact TTIGA at 512-474-1587 or by email at contact@ttiga.org

Q. I am a realtor/builder/lender and my client has placed earnest money with Texas Nations Title or I have policy related questions. What should I do?
A. We suggest that you contact those individuals to make sure they have received notice of the situation. Your assistance in helping your clients is greatly appreciated. If you know who the underwriter is, please contact the underwriter directly.

Q. I am a creditor of Texas Nations Title. Is there anything I need to do in order to protect my right to recover from Texas Nations Title?
A. General creditors will need to file a claim with Texas Nations Title in accordance with the claims filing process set out in the Texas Insurance Code. Further information will be available soon about the method and deadline for filing claims.
