September 23, 2005

To:   WORKERS' COMPENSATION SYSTEM PARTICIPANTS

Re:   SUPPLEMENTAL INCOME BENEFITS

The passage of House Bill (HB) 7 by the 79 th Legislature added Texas Labor Code, 408.1415, which requires the Commissioner of Workers? Compensation to adopt new compliance standards for supplemental income benefit ( SIBs ). Until new rules are adopted, the Division?s Rules 130.100-130.110 govern the eligibility and payment of SIBs to injured workers and they remain in effect until they are amended, repealed, or modified by the Commissioner of Workers? Compensation. To view a copy of the Division?s rules, go to www.tdi.state.tx.us/wc/rules/tableofcontents/rulesoptions.html .

In the future, the Commissioner of Workers? Compensation will adopt rules regarding the level of activity an injured worker must have with the Texas Workforce Commission (TWC) and the Department of Assistive and Rehabilitative Services (DARS), as well as, the number of job applications that must be submitted by an injured worker to meet SIBs work search requirements. Please continue to check the TDI website regularly for updates on rule proposals and for copies of informal drafts of Division rules ( http://www.tdi.state.tx.us/wc/index.html ).
