Re:   Insurance Services Office, Inc. (ISO) Fire Suppression Rating Schedule (FSRS) and Texas Public Protection Classifications (PPC)


The purpose of this bulletin is to notify insurers writing residential property insurance policies in Texas of changes to the use and filing of the Fire Suppression Rating Schedule (FSRS) and the Texas Public Protection Classifications (PPC) due to amendments to Chapter 5 of the Texas Insurance Code which were made by Senate Bill 14 enacted by the 78th Legislature, Regular Session 2003.

By Order No. 96-1377 (Order), the Commissioner of Insurance adopted the FSRS and PPCs developed by Insurance Services Office, Inc. (ISO) for all insurers writing residential property insurance in Texas. In connection with the Order, ISO asserted a proprietary interest in the FSRS and the PPC, but granted to insurers writing residential property insurance permission to utilize the adopted FSRS and the PPC for use with Texas properties only. The Department neither accepted nor disclaimed the assertions made by ISO, nor waived any rights or defenses related to the adoption of the FSRS and the PPC.

Residential property insurers in Texas may use the ISO FSRS and PPC or company specific rating schedules or systems provided they make the appropriate filing with the Department in accordance with Article 5.13-2, Insurance Code.
