We have been asked if it is permissible for a Texas Title Insurer or its Agent to make the following certification:
"This policy insures that the mortgage set forth herein is a valid first mortgage lien on the above mentioned premises in accordance with the definition contained in N.J.S.A. 17:12B-11 of the Savings and Loan Act."
We are of the opinion that it is not permissible for a Texas Title Insurer or its Agent to provide this certification.
